Fences and Hedges


 

A fence is defined as an enclosed barrier of vegetation, including plantings such as hedges and shrubbery, wood, stone or metal. All support posts should be on the side facing the owner of the fence. Support posts shall not be erected on the side facing adjoining landowners.

 

There shall be three categories of fences:

 

1.     Boundary Fence. Placed on or within 3' of the property lines of adjacent properties.

 

2.     Protective Fence. Constructed to enclose a hazard to the public health, safety and welfare.

 

3.     Aesthetic Fence. Constructed to enhance the appearance of the structure or the landscape.

 

No boundary or aesthetic fences placed in an area within 25' of the street right-of-way shall be more than 42" in height. Barbed wire, electrical and single/double and triple strand fences are prohibited in residential zoned districts, unless used in a protective fence. Protective fences on industrial or publicly owned lands are excluded from provisions of the corresponding code, except where fences incorporate the use of barbed wire, then barbed wire shall not be less than 7' above the ground level and shall be constructed to be 2/3 open division, equally distributed throughout the fence length and height located within the vision corner.

 

It is unlawful for any person to plant, cause or allow to grow, or maintain any trees, bushes, shrubbery or vegetation which obstructs the vision of any traffic sign or driveway approach to street or intersection. It is the owner's responsibility to remove such obstruction.

 

The Town shall have the right to prune any tree or shrub on private property when it interferes with the proper spread of light along the street from a streetlight, or with visibility of any traffic control device or sign, or with the vision of motor vehicle operators at any street intersection. Any shrub, tree or other plant which obstructs the view at any intersection or a traffic sign shall be deemed to be dangerous to public travel and the Town Board may order, by written notice, the owner or occupant of any private place of premises on which a tree or shrub which unreasonably interferes or encroaches upon the street or sidewalk, to take necessary steps to remove such interference. If such owner or occupant fails, within 7 days of receipt of notice, to take necessary steps, the Town Board shall order the Town Building Inspector and/or Town Highway Department employees to remove the interference. The costs of removing the interference shall be levied and collected as a special tax on the property on which or in front of which the tree or shrub stands.

 

TOWN RECOMMENDATION: 

Stay a minimum of 1 foot (lawn mower/string trimmer width) off the lot line to allow for the owner to maintain the backside of the fence without standing on your neighbor's property. The owner is responsible for the maintenance and grooming of the land/grass then behind the fence.  The Town of Grand Chute does not identify lot lines.
